Smith's attorney was unable to clear up a lingering mystery Tuesday -- the question of whether the programmer charged with spreading the Melissa virus is also VicodinES, a virus writer linked to the virus's creation. "I cannot comment on that," said Smith attorney Edward Bourden, when asked whether VicodinES was Smith's alter ego.
