Microsoft sues Barnes & Noble, Foxconn, Inventec over Android e-readers

Summary: Microsoft filed a patent infringement lawsuit against Barnes & Noble and the manufacturers of its e-readers.

Microsoft on Monday filed a patent infringement lawsuit against Barnes & Noble and the manufacturers of its e-readers.

Specifically, Microsoft filed lawsuits in International Trade Commission and the U.S. District Court of the Western District of Washington. The targets: Barnes & Noble, Foxconn International Holdings and Inventec. The latter two manufacture Android e-readers sold under Barnes & Noble's nook brand.

Microsoft's patents cover everything from the user interface to tabbing through screens, document interaction and Web surfing.

From Microsoft's complaint:

Microsoft is the owner of all right, title, and interest in U.S. Patent No. 5,778,372 (the “’372 patent”), U.S. Patent No. 6,339,780 (the “’780 patent”), U.S. Patent No. 5,889,522 (the “’522 patent”), U.S. Patent No. 6,891,551 (the “’551 patent”), and U.S. Patent No. 6,957,233 (the “’233 patent”) (collectively, the “Microsoft Patents”), which Defendants are infringing and/or inducing others to infringe by making, using, offering to sell, and/or selling in the United States, and/or importing into the United States, products or processes that practice one or more inventions claimed in the Microsoft Patents.

In a statement, Microsoft's Horacio Gutierrez, Deputy General Counsel for Intellectual Property & Licensing, said:

The Android platform infringes a number of Microsoft's patents, and companies manufacturing and shipping Android devices must respect our intellectual property rights. To facilitate that we have established an industry-wide patent licensing program for Android device manufacturers. Other vendors, including HTC, a market leader in Android smartphones, have taken a license under this program, and we have tried for over a year to reach licensing agreements with Barnes & Noble, Foxconn and Inventec. Their refusals to take licenses leave us no choice but to bring legal action.

Translation: Pay up already.

      Since they are always getting sued and others are out suing each other, why sit around and let it go to waste. Its the market we are in with patents and every major manufacture out there is suing someone and being sued themselves. Just look around you because you can't find a company not doing this these days.

        Meanwhile the Obama administration sits on its ass as does nothing to address the greatest impediment to American innovation: the utterly broken patent office. ABOLISH SOFTWARE AND "BUSINESS METHOD" PATENTS. They are used to steal people's work and bully innovators.

        Software is an algorithm and is already supposed to be non-patentable. PERIOD.

      • Android infringes on more than MS patents. It violates GPLv2.

        People actually think Google is giving away Android.
        The "Gold" code that goes to the handset makers and carriers has proprietary, stolen Linux code.
        Google makes a tidy sum on every device running android sold.
        You can download the generic version of Android but it's not the code that goes out on devices.
        And Google has the gall to say their deals with handset makers is nobodys business.
        Google is EVIL. They always hagve been, always will bo.
        They use the FOSS community to their own ends, but the Gomers who contribute code to FOSS are too thick and naive to even know what hit them.

        @Will Farrell You need to refresh yourself as to who steals more ideas from whom. And in most cases, they ALL steal ideas from 30 years ago - the hardware was just too expensive back then to make it economical to implement.

        @Sultansulan That's the best you can come up with? Microsoft is an old company that is trying to find its way out of 1999 thinking. They have great engineers that are trampled on by executives who should have been fired 8 years ago. Microsoft doesn't do anything that Apple wouldn't do. Apple just does it better in the consumer space. In the enterprise, IMHO, no one makes a better dev environment than Microsoft, and all the tools are FREE. Apple innovates. Microsoft puts it int he hands of the business (usually much later), and Google gives it away hoping you'll click on their ads. There's no evil here, just business.

        So when the FOSS mob, or small companies sue the pants off the Big Multinationals, their actions embody the "righteous cause" - even if the patents in question relate in some cases to unimplemented/untried concepts, and the one being sued has done all the hard work!

        But when the Big Multinationals do the same - especially when it involves the OSS/FOSS community... DEVILS!!

        The number of devs working with open source outnumbers MS devs far and away, yet they can't get a desktop OS that isn't a feeble attempt at copying Windows with no success after 20 years of trying.

        The MS ecosystem creates jobs, which creates economic growth and maintains strong family units which are the foundation of a civilized and moral society.
        FOSS on the other hand advocates living from FOSS and FOFF alone, no kids, no house, put all of your efforts and money into FOSS to take over the world.
        Ans worse than a "greedy" company is software that is backed by the government. Unix, which Linux was modeled after and there are many bits of information pointing to the linux kernel and gnu were written with Unix and Minix code in hand, has always had the government backing.
        Unix vendors such as SuN were granted monopoly immunity after the projects to create a modern and secure Unix, paid for by the Feds was privitized. Scott Mcneally being a great example. The work at Stanford and berkeley and private research facilities, such as were Mr. Cerf "invented" tcp/ip, were all funded 100% by the U.S. government. That is the money of working people, so speaking of evil and slimeballs. then McNeally was allowed to run with the technology from these facilities and create a private company, started up with taxpayer dollars, what a slimeball McNeally was/is eh?
        but that anti-trust exemption was not needed. McNeally never turned SUN into much of anything except a jealous company that couldn't stand seeing MS succeed in a market they never conceived of. Yeah, not many home users were in the SUN workstation market.
        So McNeally tried to piggy back on MS success with "middleware". And so MS is the evil one?
        The jealousy that has run through the OSS community since MS built it's empire has been astonding.
        Every company that complained to their captial investors....the FEDS....that includes Apple, had a huge headstart and all of the resources of the federal goverment supporting them along with AT exemption for several years and they still did not see the true market nor understand it's potential.
        MS did, but that makes them evil because they beat out IBM, SUN, APPLE and the rest of the IT big guns of the day.
        Don't let your jealousy show too much.
        Windows 7 uptake continues to increase like wildfire, ensuring MS will be the market leader in desktops and Enterprise server/client software for another generation.

        Further I've stated many times my dislike for Ballmer and my continuing hopes that Microsoft ditches him, sooner rather than later.
        I don't live by the double standards you somehow have, yet believe only others have. I know Microsoft's weaknesses and faults and that the CEO has shown he is incapable of leading the company into this century.
        I've repeated his lines from speeches at universities with strong business programs, about how they need to learn to "milk" every product for all it's worth and my total disgust and disagreement with his philosophy.

        Now as far as my "propoganda rant" goes, please point out anything from it that is not true and historically accurate. If you can't, then don't bother replying. We'll understand.
