Oracle rested its case in its TomorrowNow trial against SAP and former CEO Leo Apotheker won't be taking the stand.

AllThingsD's John Paczkowski, who gets Photoshop of the day for the WWE-style Larry Ellison off the top rope, noted that Oracle called its last rebuttal witness Friday. Ultimately, Oracle decided to refrain from showing Apotheker's two-year-old video testimony.

Oracle was trying to subpoena Apotheker and being rather vocal about it. Hewlett-Packard said Oracle was just trying to harass its CEO.

So with the Oracle-HP-Apotheker subpoena drama out of the way, the TomorrowNow case will soon go to the jury.

Then we get the bottom line damages that SAP will pay.

As for Apotheker, HP reports fourth quarter earnings on Monday and the new CEO is likely to have a few comments about the business.
