Verizon to AT&T: "Our ads are true and the truth hurts"

Verizon Wireless responded today to a lawsuit filed by AT&T earlier this month that accused Verizon's "There's a map for that" marketing campaign of misleading consumers about AT&T's 3G coverage in the United States.

In a nutshell, Verizon said AT&T's request to have the ads pulled is without merit. From the court filing (PDF):

AT&T did not file this lawsuit because Verizon’s “There’s A Map For That” advertisements are untrue; AT&T sued because Verizon’s ads are true and the truth hurts... AT&T now is attempting to silence Verizon’s ads that include maps graphically depicting the geographic reach of AT&T’s 3G network as compared to Verizon’s own 3G network because AT&T does not like the truthful picture painted by that comparison.

In the court filing, Verizon outlines the reasons that AT&T's arguments are without merit. They include:

  • Because the ads are truthful, AT&T is attacking them under faulty theories, including a claim that they are misleading. But Verizon says there's no real evidence - aside from an AT&T commissioned survey - that proves that consumers are misled by the ad.
  • There is no emergency that would require the court to issue an immediate restraining order - as AT&T has requested - without giving Verizon the opportunity to conduct its own research and present evidence to prove that consumers are not being misled.
  • The harm to Verizon and the public, in general, caused by pulling the ads is greater than any alleged harm being inflicted on AT&T.

Those are all fine-and-dandy arguments about why the courts should deny AT&T's motion but the main reason comes back to the headline statement: The ads are true. Period. But regular readers already know my thoughts on this AT&T-Verizon back-and-forth. Instead, I offer one more excerpt from Verizon's filing that I think sums it up best:

AT&T seeks emergency relief because Verizon’s side-by-side, apples-to-apples comparison of its own 3G coverage with AT&T’s confirms what the marketplace has been saying for months: AT&T failed to invest adequately in the necessary infrastructure to expand its 3G coverage to support its growth in smartphone business, and the usefulness of its service to smartphone users has suffered accordingly. AT&T may not like the message that the ads send, but this Court should reject its efforts to silence the messenger.

I couldn't have said it better myself.

            It was never mentioned in the Clementine Vulgate, and Hades was originally the greek god of the underworld. However, the point is moot as you or I will never see the original Aramaic.

            Either way, I have a hard time believing anything, much less a book that over the course of two millennia has been truncated by 20%, and has gone from professions of a gender balanced polytheistic structure to a single patriarch.

            Hades is a Greek word, meaning: that which is out of sight, the state or place of the dead. Equivalent to the Hebrew: sheol.

          • Which version is this?

            Every version of the Bible I have see has mentioned hell. Never Hades. In Greek Mythology Hades is where the dead dwell. All of them, not just the ones being punished. In the Christian Bible Hell is a place of punishment and torment. Once again two diffrent mythologies. The question is, do they have an app for that?

      • I can tell you're excited but please refrain from exaggerating.

        Barely .01% of the US population will even hear about this lawsuit. This will not make more people move to Verizon. The commercials are doing that all by themselves. This suit brings no added 'free' publicity.

      When Verizon shut down Amp'd Mobile they were unable or unwilling to convert a phone I really liked over to their service. I therefore refuse to ever do business with them again. AT&T works just fine here in New York and they are ethical. Much more than I can say for Verizon.

      Hardly a reliable source. Wireless coverage varies by location, even your precious AT&T. Everywhere I've been coast to coast, I've always had service with Big red. However you DONT hear about Big red having a 30% dropped call rate for their smartphones eh? AT&T does.

        And I've never had a 30% dropped call rate on AT&T in those areas.

        • Ok...I'm reminded of YMMV then..

          I'm from Central PA (Lancaster County) and visit family there quite often. Rarely a dropped call there too. However, your mileage may vary depending on device. I cant speak for Northern NJ, however going from the eastern shore of MD up through DE and into PA, never a dropped call. Now there is one place, Port deposit? that the phone does cut out for a few miles, but its virtually in BFE - if I recall right AT&T doesnt work there either.

            the main point of this post is talking about 3G
            coverage for data.. not voice. there is a little
            effect on voice also but those are 2 different
            maps lol. actually AT&T has like 4 maps 1 for
            every level from voice to gprs to edge to 3g.
