With these iPad Smart Cover knock offs, Samsung shows why Apple is suing it (Updated)

Summary: These Smart Cover knock-offs designed for the Galaxy Tab 10.1 and sold in Samsung’s Korean stores give a pretty indication as to why Apple is targeting Samsung.

With all the ongoing litigation over alleged patent infringement and general legal nastiness, you might think that Samsung would be on its best behavior with its latest product offerings. But that’s really not the case judging by these Smart Cover knock-offs designed for the Galaxy Tab 10.1.

Featuring much of the same functionality as Apple’s Smart Covers, these nearly-identical “Smart Cases” are sold in Samsung’s Korean outlets. While not made by Samsung directly, the cases were manufactured by Anymode, a company that 9-to-5 Mac says has family ties with Samsung itself. This may explain how the things got sold in Samsung’s stores to begin with.

Update: On Tuesday, Samsung responded to the allegations via an official statement. Apparently, there was some oversight with the Anymode Smart Cases getting Samsung’s approval.

“As a general practice, Samsung Electronics reviews and approves all accessories produced by partners before they are given the “Designed for Samsung Mobile” mark.

In this case, approval was not given to Anymode for the accessory to feature this official designation. We are working with Anymode to address this oversight and the product has already been removed from the Anymode sales website. The product has not been sold.”

The iPad’s Smart Cover has been the subject of quite a bit of controversy since its announcement, not the least of which being that Apple itself has been accused of stealing the idea from accessory manufacturer InCase

Did they patent this magnetic case design?
@Droid101: design is patented, of course. However, it takes years after application to get patent -- and this is the reason why the current patent system is half-useless. Apple can not sue anyone for good which do not yet have patents.

This is why Apple could not sue anyone for gesture-based multi-touch mobile UI on capacitive screens until last year -- Apple's key patents for that, while being filed in 2005-2007, only were issued by the end of 2009.

Apple does NOT have a patent on gesture-based multi-touch mobile UI.
They have patents on various algorithms used to determine user intent in gesture-based multi-touch mobile UI. There is a VERY big difference.
@DeusXMachina: ... described. I never said there is one certain patent for the whole thing (iPhone-related portfolio is more than 200 patents).

What are the IP laws in Korea? Even if it was patented, will Korea hear a case if it is purely in Korea?

Those are the questions that a journalist would ask.

@mikies Then tell us why smartphone used to more closely resemble the Treo until the success of the original iPhone then suddenly all the smartphones began to resemble the iPhone. And tell us how Android first resembled the Blackberry OS until the success of the original iPhone and now it much more closely resembles iOS. And also can you tell us how come the original Windows OS GUI very closely resembled the original Mac OS GUI which was released prior to Windows.

@ConceptVBS: ... even colours are different. Apple developed magnet system for the case, which makes the whole "magic" of it, not outer shape.

Both companies merely repurposed the design of a VERY common accessory in Japan and Korea, the folding bathtub cover. So before you make declarative statements, you might want to determine if you know what you are talking about!
Also, the inCase product does NOT include the magnetic clasps, the magnetic hinge, OR the auto-sleep sensor trigger. As these are the truly interesting features of the case, NOT the fact that if folds into a triangle, SO FREAKING WHAT?!?

So, in order for a story or source to be credible nowadays... it just has to be a fan blog site dedicated to a certain company... and they can even go so far as to say: "...claim we were unable to verify at the time of this writing." That's all we require, eh?

I mean, nevermind Samsung being held responsible for a product they don't even make. 9to5Mac said so, so BY GOD that's the way it is! Aren't the fanbois aware that only Steve Jobs can be the uncontested, all knowing?

Let us hope 9to5Mac and Steve Jobs never disagree, or the sun will go supernova.

Thanks for making it clear that you don't know how Japanese and Korean companies operate. Anymode is a Samsung affiliate, as in direct business subsidiary, with the same set of owners and stockholders.

The very idea of suing someone for "copying" is ridiculous in and of itself. It has no merit whatsoever-and Apple knows that. The way to counter this irresponsible behavior is doing exactly what Samsung is doing-in your face. Then of course the original lawsuit is amended to include "blatant behavior offending to Steve Jobs". This is the reality of life in the 21st century.

I'll never buy a non-Apple product again!
- suing them over a piece of plastic with grooves. Here I made a piece of piece of plastic with grooves in 1970, so all will pay me now instead. Isn't there something better to sue over something that is complex and too time to think up? This and suits like it are really trivial.
