Consumer files complaint against Apple India with Competition Commission

Summary: Alleging anti-competitive practices, a user has filed a complaint against Apple India with the Competition Commission of India claiming Apple is limiting users who want buy iOS devices by partnering with careers.

A user has filed a complaint with the Competition Commission of India (CCI) accusing Apple India of following anti-competitive practices in selling its iOS based devices.

The complaint claims, under section 4 of the Competition Act, Apple is restricting customers to purchase iOS devices from specific stores and carriers. As of now, only some authorised Apple retailers are selling iOS devices. Traditionally, cell phones in India are not sold with a carrier contract. Unlike the US, users are free to purchase handsets of their preferences to be used with operators of their choice. When the iPhone was launched in India, it was available for a contract with Vodafone or Airtel. In the US, a handset is subsidised if bought with a contract which means:

  • Locked iPhone (16GB) handset at $199 with an AT&T plan at roughly $60 a month
  • Unlocked iPhone (16GB) handset can be bought at $649

In India however, a locked iPhone handset with contract costs more than $600 and operator's monthly charges additional. The carriers are taking undue advantage of Apple's exclusivity, irrespective of how much they paid for it. The CCI should look into this carrier malpractice during their investigation since a carrier-locked handset is being sold at the price of an unlocked iPhone. I believe Apple India is not involved in determining the iPhone prices. Apple launches iPhones in India almost an year after they've been released in the US which means they do not consider India as a potential market.

The relevant section from the act (PDF link) says:

Abuse of dominant position

There shall be an abuse of dominant position [under sub-section (1), if an enterprise or a group]

(a)  directly or indirectly, imposes unfair or discriminatory—

(i)  condition in purchase or sale of goods or service; or

(ii)  price in purchase or sale (including predatory price) of goods or service.

(b)  limits or restricts—

(i)  production of goods or provision of services or market therefor; or

(ii)  technical or scientific development relating to goods or services to the prejudice of consumers; or

(c)  indulges in practice or practices resulting in denial of market access [in any manner]; or

(d)  makes conclusion of contracts subject to acceptance by other parties of supplementary obligations which, by their nature or according to commercial usage, have no connection with the subject of such contracts; or

(e)  uses its dominant position in one relevant market to enter into, or protect, other relevant market

The Commission is expected to look into this complaint by end of this week.

Update: As pointed out by some enthusiasts, an unlocked iPhone 4 is available in India from Airtel and Aircel. Regardless, the phones are still sold by the carriers.

    How many of us would really buy an unlocked phone with 2 year of carrier locking here in the USA? Carriers there in India should subsidize the phone if they are going with contract route, otherwise they should just simply sell unlocked phone. and I think Apple will definitely lash those carriers there in India for doing such malpractice by taking advantage on both sides. These carriers might be getting the device for subsidized price from Apple, because of bulk purchage and negotiations and on top of it they might be charging their own tax in addition to govt. import tax there in India. I don't know how much of duty they charge on these, because I moved away from India way long ago, but in my opinion these carriers are really taking advantage of the situation and demand there. I know a lot of people are looking for iPhone and got tired of cheap Android devices in India.

      @Rama.NET the iPhone 4 is sold factory unlocked here.. apparently the writer does not know it.. n also if you want u can get onto a plan from airtel and aircel and get reverse subsidy.. where they give u a discount on their plans.. good stuff..

      @Rama.NET What exactly do you mean by "cheap Android devices"? Are you implying that all Android devices are inferior in quality? If people are willing to pay $600 for an iPhone, they could get an equivalent Android device for that price too, if they wanted.

    Why would a consumer agree to this? If some carrier tried to charge me full price for the phone AND say I have to sign a multi-year contract, I'd ask the obvious question: What are you giving me for me agreeing to be bound to you for 2 years? I might consider this contract if you significantly reduced the price of this phone. Otherwise, I'll buy this other smartphone from your competitor WITHOUT a contract.

    People need to just walk away from bad deals. It's amazing what people put up with.

      @Digital Video Expert the writer has not done his research.. all iPhone 4's in india are sold factory unlocked.. n airtel n aircel give u an option on getting onto a plan with them where over a period of time u get discount on yr bill and can total upto the cost of the iPhone..

    You can not bring the food from elsewhere to MacDonalds, and the same story is with every restaurant.

    Where is "antitrust" complaints about that? I mean, seriously, this guy can hardly be any more [b]ridiculous[/b] with the complaint.

    seriously dude.. do some research. the iPhone 4 is sold factory unlocked. atleast do a balanced story on how operators (airtel n aircel) are also giving reverse subsidy. half-baked article.

    @helpfulmeister I think complain was one year or more old when iphone 3 used to be only with Vodafone or Airtel.

    Story has changed recently when iphone 4 started selling with Airtel and Aircel.

    Still, complain stays. Why can't I buy iphone with other so many Apple stores and Apple distributors around me. I think if they where with Apple distributors they would have pushed iphone earlier in India not not after year of its original launch date.

    I just bought one iphone 4 from a Mall that has no link to apple ,airtel or aircel, But the guy at the counter told me that it can not be used with any carrier other than airtel or aircel.But I still bought it thinking that it could be jailbroken and thus use other carrier sim i am using.But after searching internet I found that the iphone4 with the modem 4.10.01 can not be carrier unlocked. Now that some of us saying that Iphone 4 launched in India is not carrier locked, who will confirm the same ? If it is not locked then it is ok , else we need to curse apple for selling such high priced phone from any store.In any case I did find the scheme of one of the carrier useful to me , but that should be a option ,not binding to me.
