Apple loses bid to ban Samsung’s redesigned Galaxy Tab

Summary: In the continuing fight over patents, Apple has lost its bid to secure a preliminary injunction against Samsung’s modified Galaxy Tab 10.1N tablet. At least, for now.

In the long running battle over patents between Apple and Samsung, the latest twist comes from a German court which ruled that the redesigned Samsung Galaxy Tab 10.1N will not be banned from German stores.

Apple submitted a motion for a preliminary hearing against the modified tablet, but was denied. It was found that Samsung’s Galaxy Tab 10.1N was reasonably distinct from Apple’s products, and therefore should be allowed to go on sale.

It should come as no surprise, according to FOSS Patents author Florian Mueller, because a Dusseldorf regional appeals court said last week that, “even the original Galaxy Tab 10.1 does not fall within the valid scope of the asserted [patent].”

Apple last week lost a similar attempt, where the company invoked a European design right, in a Munich court.

Should Samsung have failed today, it may have had to redesign the product all over again. But though at this stage this is only the denial of a preliminary injunction, it could be that later down the line Samsung products are banned nevertheless.

Apple continues to assert four different design-related patents are being infringed by ten Samsung smartphones and five Samsung tablets. It’s clear that Apple will not let these go without a fight.

Zack Whittaker, criminologist who studied at the University of Kent, UK, is a journalist, writer and broadcaster.

After studying criminology at university, though still in his early-20's, he has already had a series unconventional work and voluntary positions. He has worked with researchers studying neurological illnesses like Tourette's syndrome (which he suffers from), has given lectures on the nature of disabilities in the public community, and occasionally ends up speaking on television and radio discussing the events of the day.

He first had academic work published at the age of 22, then still an undergraduate, and has been cited by a wide range of publications: from the Huffington Post, Business Insider, AllThingsDigital, The Atlantic Wire and CBS News.

This is really sad and unbecoming of Apple. Why can't they just let it go already? They succeeded in getting Samsung to change the appearance of the tablet. It just looks like sour grapes and greed at this point. Yuck. Lawyers.

Don't blame the lawyers, they need work the same as everyone else. Who hired the lawyers?? There is the blame! As to the comment that Apple won't give up without a fight, if they keep getting knocked down and getting knocked out, they eventually won't have any fight left. Just saying!!!

Suddenly a court's decision doesn't count any more. When any court decision comes down against an Apple competitor, the Apple fanboi states "See, it was determined to be true in a court of law." When any court decision comes down against Apple, the Apple fanboi states "But that wasn't fair, the judge was wrong, the court was wrong, I have proof" as if the Apple fanboi's proof trumps the decision of a court judge.

Why can't these Apple fanbois accept the verdict? The Galaxy Tab is not a slavish copy of the iPad. This has been determined in a court of law. That is all that counts.

REDESIGN means they were in violation before but did enough to be acceptably different .... what they should have done from the beginning.

Then why did Apple not drop the lawsuit? Apple didn't feel that the redesign was acceptable and continued the lawsuit. No ruling was ever made on the original design so none of us will ever know what the ruling would have been had Samsung not changed anything.

The facts are that Apple sued Samsung and LOST.

You know who you are. You told us all that Apple won because they forced Samsung to redesign the Galaxy Tab and once Samsung did that, it meant that Apple won. If that was true, why did Apple seek to ban the redesigned Tab? Clearly Apple did not feel like it had won. And with today's ruling, it is now clear that Apple's patent offensive against a tablet that was clearly not a copy of the iPad is DOA. It failed miserably. Apple lost the battle big time. Losers.

Don't get me wrong though, Apple won the war big time. Winners. With 97% marketshare and 100%+ profitshare in the tablet market, this loss means nothing other than it being very embarrassing to Apple and even more embarrassing to everyone who accused Samsung of slavishly copying Apple. You were proven wrong again today. By a court of law.

@toddybottom_z - They didn't drop their lawsuit because, on the off chance they would win, they stood to protect that market share. And if they lost the bid, the cost of filing the motion was miniscule compared to the potential dollars involved. The same rationale people use every day - I won't get caught if I speed 5 over the limit; I will buy the powerball ticket today because the prize is $250 million; I will bring my own tablet to work because it is less costly to my time than to try to get my IT department to buy the one I actually need... The real shame here, as far as I can see isn't the lawsuits, it is that Apple ever got the patents in the first place. Patenting the FORM FACTOR? Seriously?

Because it is a new design that Apple feels STILL infringes on their trade dress patent. Duh. Getting the redesign WAS a win for Apple, on the case re: the original Galaxy Tab. This is a new device, and a new suit. There is no logical connection.

This ruling does not change any of that.
The only reason someone would buy a Galaxy Tab is if they were misled into thinking it was an iPad. The German Court's ruling is essentially that they don't think people are that stupid.

@jimbotomy I bought over a dozen of them, I know it dont have a picture of fruit on it... But the built in GPS w/o the cell phone service needed, out corp web sit has flash used and java script, We like to be able to put files on the devices w/o using ITUNES, simply plugging cable in and dropping files on off is good enough, and YEa the cost, we can get Galaxy tabs for 60-80 bux cheaper than the fruitty ones.... If you like apple that much look for the fruit on the front and buy it.

Since you can run Flash sites just fine on the iPad (certainly javascript, the back bone of much HTML5, runs fine) and you are able to load files onto an iPad without iTunes with no issues, one wonders that you think you are talking about. Maybe you just hope to make clear that your IT people (you?) are incompetent?

I saw the original design of the Samsung Galaxy tab and I am not sure how it could have been mistaken for an iPad with Samsung clearly labeled on the front and back. I guess I feel all Tablets look very similar at first glance and there is only so much you can do to make them look distinctly different. Maybe they should put a label on it that says "Not an iPad and Proud of It"

I remember reading about that somewhere else and if I remember correctly they were comparing at a pretty decent distance. Besides they are lawyers and many lawyers will do or say anything to get into court because that is how they get paid. The law to lawyers has become more about the money than actually defending the law to many lawyers. I bet to them a Dell Laptop and an HP Laptop look pretty much the same from a distance too.

But in all reality the original Galaxy Tab design was a bit different in shape and screen shape and even in thickness. With the screen off at a distance they are very similar. I have had people think my Android Tab is an iPad at first glance too. Then there are people that call my HHR a PT Cruiser. Ignorant people will always be around and Apple was looking for more money and to eliminate competition. I don't see them fighting so hard at the chinese knock-offs that look exactly like the iPad/iPhone

Exactly right. Some Apple fanbois simply can't stand that the judge in a court of law doesn't agree with Apple. They will continue to claim that Apple was right long after Apple was proven in a court of law to be wrong. These Apple fanbois keep on bringing up "evidence" without realizing that their "evidence" was either already heard by the judge and factored into the decision that Apple was wrong or it was not brought up by Apple's lawyers because even Apple's own lawyers understand that this "evidence" is absolutely meaningless.

I have a message for you Apple fanbois: Apple was found to be wrong in a court of law. That's it. Deal with it. Cry if you need to. Troll on ZDNet if you need to. None of it changes the fact that Apple was proven to be wrong in a court of law.

The distance from which Samsung's lawyers were looking at the tablets was reported to be about 10 feet.

Despite what others say, there are ways to make tablets that look different. Sony's tablets cannot be confused with Apple's, and are quite good looking. It all comes down to whether a company wants to make products that stand on their own by their difference with other products, or whether they just want to piggy-back on others' work.

Sony's tablets, as I mentioned, are nice. Microsoft didn't try to copy iOS; instead they came up with Windows Phone 7, which I think looks quite good also.

These are the products that I find the most interesting on the market now, because they show me that the companies behind them are 'thinking different.'

i don't understand these incessant legal battles either. I guess Apple wants to keep playing king of the hill(since they are #1 in sales for tablets).

I can't say any tablets are truly all that useful(yes I do own one and it is based on android, well actually CM7 so it's more user friendly but that's another story).

Motorola gets bans on Apple, Apple gets bans on Samsung. Is all this infighting really going to change who buys what they personally want? I doubt it. Apple guys will pretty much always be Apple, Android will always pretty much be Android. I'd bet that it's a very small percentage that goes back and forth.
I'd bet even more that the average consumer that buys a tablet buys it because it fits their budget versus whether it's one brand or not.

We all want to drive Corvette's and Cadillacs(Ipads and High end androids) but many us of are stuck driving Impalas and minivans(the rest of the lot).

First, because it is theft. Second, Android people switch to iOS on a regular basis. The reverse is not really true.
This is preposterous - the Galaxy Tabs have black plastic and rounded corners and touch screens - all Apple INNOVATIONS that need to be protected as valuable INTELLECTUAL property. Keep going Apple, don't let those Koreans STEAL your designs.

apple didn't invent the rounded corners ,it has been there for very long time and look around you most stuff (electronic or not) has rounded corners including your car.
i own an iphone and waiting for ipad3 to be released and love apple products but i try to be fair and i would say apple did not "invent" many of the "inventions" of the iphone and the ipad but rather they made the right blend of these preexisting inventions and technologies and thus made the right products.

I wonder if all this focus Apple is casting on current and older designs through litigation is designed to keep the companies that mimic Apple off balance. Basically distract them from what Apple has in development.
