Please Apple, stop this petty litigation!

Summary: Another day, another Apple lawsuit trying to prevent competition.

Another week passes and Apple has once again forced legal action to stop HTC from selling Android phones. This follows successful litigation against HTC that forced them to make slight changes in the way HTC phones worked. Apparently Apple believes the changes HTC made aren't significant enough to protect Apple's great innovation. I don't think I am in the minority when I state that I am getting very tired of all the litigation for apparently little gain.

That's right, I believe it's time for Apple to stop this litigation nonsense and let the market work as it should. It's not like any company Apple goes after is confusing the market and stealing its business. Look at the numbers -- Apple is dominating the entire mobile industry by producing good products so why isn't that enough?

See related:

It's entering the seamy realm of petty behavior, all of this non-stop litigation. It's not like Apple needs to do this to stay on top, its products achieve that. Why isn't that good enough?

Legend has it that Steve Jobs hated Android to the point of wanting to destroy it. That must be true as it seems to be behind the constant global litigation that Apple keep instigating. Enough is enough, please stop this and compete in the market, not the courtroom.

Fact is, if Apple has it in for Android then why not go directly after Google and the platform itself? Not keep suing one company or another that merely uses the platform. It's not like competing products are confusing buyers into thinking they are getting Apple products when they buy from the competition. It's beginning to seem downright petty, and that isn't good for anyone, least of all consumers.

Every company wants to protect its innovation, I understand that. But just because the broken patent system lets simple changes be patented doesn't mean it's right, and it doesn't mean you should keep suing to stop competition, Apple.

You make good products that speak for themselves (even answer), and that should be good enough. Are you afraid of the competition, Apple? You shouldn't be, and if that's not the reason behind the constant legal gymnastics then maybe you really are just being petty.

Apple, you are legitimately winning on the only battlefield that matters, the consumer marketplace. Let that be enough and stop this legal shenanigans. It's getting really old, and doesn't make you look good at all.

  • Everything including life itself is a game. The rat race for instance a

once common phrase to describe life and or business. This too is a game and from Apple's perspective it can play all night and day and "IF" it gets results I can't blame Apple for playing after all Apple has suffered in the past for actually NOT playing.

    • we agree in the community!

not only should apple stop the frivolous lawsuits, but should also apologise to the FOSS community.
People are preferring android for a good reason, and that's because of FOSS innovations, not apple's cool jail.

      • Samsung has to stop frivolous plagiarism

But Samsung continues continue to rip off Apple designs -- here is example from only few days ago:

So, of course, there is no way that Apple would stop this highly warranted litigation.

        @DeRSSS
Who would have ever thought basic shapes were design innovations???... Please; it is a square with rounded off edges - I have routers from early 2000's that look like this. It is as absurd as the patenting of the iPad design, as if it is not completely logical that a tablet design be in the shape of a rectangle with rounded edges. If you weren't such a blatant fanboi or paid Apple shill (not sure which you are yet), maybe you could see how illogical your argument is.

      • Isn't it a little strange, DeRSSS, that you're looking at the bottom

of the Mac Mini, (straight on) showing the access panel, while looking at the front and side of a what - Samsung chomebox?

But that very design and shape, as well as the access panel had been used before in another product (not counting tanks, manhole covers, ect) but in electronics.

But go look at some sub woofers, tell me that design hasn't been used before.

SoSamsung copied Apple, who copied someone else. All's fair.

Yep.. you're right! I would absolutely confuse those 2 products. There's simply no way for me to tell if I'm buying a Samsung product or a Mac Mini.

      • NetAdmin1178, you're right

the Mac Mini does look alot like the Linksys RVS4000 router.

Did Apple steal that design, I wonder?

      • @DeRSSS - Apple has to stop frivolous plagiarism - and twisting facts

Since Steve Jobs claims 'slavishly copied', let's look at who copied who, first, shall we?

The iPad is supposedly 'covered' with a frivolous design patent from Apple, and also Apple made a vicious false claim of plagiarism against Samsung:
        http://lmgtfy.com/?q=samsung+photo+frame+tablet+2006

All false malicious claims which will get invalidated, and Samsung will be completely vindicated by the court of law all over the world.

Ironic that Samsung and Samsung alone gets to decide whether to supply Apple with essential CPUs? Now who really needs who? It's hard to make a quarter, and keep speculators happy, if one cannot sell anything for up to 18 months?

If you knew anything about design patents, maybe you'd understand.
        msalzberg
      • Photo frame is different category, so this example does not prove any thing

@WinTard I can design a mirror with that design and it will have nothing to do neither with photoframe nor with tablet. You can not patent design not assigning it to a specific category.

But when Samsung all of sudden decides to use the same design as Apple in the *same* category, this is a trade dress infringement.

And Samsung does it continuously with many of their products.

It's a square with a circle in it... Do you honestly think Apple was the first to make anything in that shape?

YOu apparently haven't been keeping up.....

    • Hmm

Well, what game is Google playing? Apple is not forced to sue. When is the last time Google initiated an IP lawsuit? Is it because nobody copies them? No, lots of people try to imitate them. You 'can't blame Apple' for being the most litigious technology company in the world? You can't blame them for trying to create a holy war against Android? You can't blame them for initiating petty lawsuits based on ridiculous and obvious patents?

Well then, I'm not sure where you're coming from.

Companies are made up of people and run by people. People make decisions. Companies are not mindless cash machines willing to throw anyone else into the meat grinder to raise their market share or destroy the competition. Or at least they shouldn't be.

Ironic that Steve Jobs stated "We have alway been shameless in stealing great ideas

      • Google (through Motorola) started suing Apple first.

Simple fact. Your God Google is just as guilty.
        Bruizer
      • Google is not my god

Motorola is not Google and Google had exactly zero influence over Motorola's litigation that you refer to.
        dorkistope
      • @Bruizer Could you be any wronger?

Google wasn't Motorola at the time the lawsuits started flying. Google purchased Motorola as a strategic defense against the onslaught of lawsuits Apple was volleying against their distributors.

Apple is a dirty patent company, and had it not been for them, Google would have never purchased MM.

I think it is your God (Apple) that has failed you.

At this point apple is copying android features like roll shade notifications and bigger screens in the new iphone. No one is blameless here.

Bigger screens are not an Android feature. C'mon man, that's just as bad as people claiming that Samsung copied Apple on the shape of a tablet.
