The SCO-IBM suit is not over, yet. But it may never get to trial.

U.S. District Judge Dale A. Kimball refused to dismiss the case yesterday, but his statements from the bench indicated he will immediately following discovery unless SCO comes up with real evidence.

The Salt Lake Tribune quoted him saying "SCO has not offered any competent evidence" to back its claims that the Linux IBM uses infringes on SCO'sUnix. The judge will rule on two partial dismissal motions from IBM on February 25, and reminded IBM lawyers they can re-file for dismissal once the discovery process is complete.

If SCO's case clears discoverya trial will begin in November. Right now that looks like a pretty big if.

What do you think? I think it no longer matters whether the SCO case is dismissed or not -- a plague of lawyers has descended upon Linux that will be as hard to eradicate as spam.
