If it's in the EULA it isn't spyware
I think if the EULA accurately discloses the installation and function of software, then it can't be called spyware.

There are two other categories that are more important I think. One category is software that gets installed by other software that is not disclosed. Since it is not disclosed, it is not in the EULA. The other kind gets installed as cookies while we use the internet in very normal manners.

I have used Ad-Aware occasionally for a couple of years. I don't remember having any spyware except the kind that exists as cookies and gets installed by web sites without my knowledge. However I definitely notice performance loss before removal of spyware and of course performance gain after removal of spyware (by Ad-Aware).

I have learned how to turn off cookies permanently for only specified sites and now when I run Ad-Aware it is not finding anything to delete. The technique is relatively simple but too complicated to explain here.
