I would have agreed with you.. except for the fact that "the very least we can expect from users" would not have protected them from this last batch of flaws.

Just by visiting certain infected websites.. you get the trojan. Now THAT'S scary!!

Of course, there was a patch for these servers.. so I'd question if there's any legal liability for any company that doesn't patch its servers, leading to visitors being infected. But that's another question entirely..
