Apple fights Samsung request to see iPhone 5, iPad3 models

Summary: Samsung's request to see early copies of Apple products didn't go over well with Apple.

Apple finally responded to Samsung's late May request to see the "final, commercial version(s)" of the "iPhone 4S," "iPhone 5," "iPad 3," "third-generation iPad," and their retail packaging. Monday, Apple filed a motion in the District Court for the Northern District of California asking the judge to deny Samsung's request.

According to the documents Apple says, "Rather, it is a transparent and improper attempt to harass Apple by demanding extremely sensitive trade secrets that have no relevance to Apple's infringement claims or to Samsung's defenses to a preliminary injunction."

Apple originally sued Samsung for "slavishly" copying the look and feel of iPhone and iPad products and requested copies of announced, though unreleased, Samsung products, including the Galaxy Tab 10.1 and 8.9, Galaxy S II, Droid Charge, and Infuse 4G. Apple said it wanted to evaluate these announced devices to see if they, too, would fall under the same intellectual property infringement claims Apple had already placed on other Samsung devices already in the market. Samsung responded by filing several patent infringement lawsuits targeting Apple's products in multiple countries.

      @Bates_ Nice try but FAIL, annouced but unreleased products are not even remotely the same and not yet announced products.

        replying to your post as it is the top post with this argument, Samsung requested "unreleased and unannounced" product disclosure, because Apple doesn't announce products until the week they are releasing it. Kind of makes it hard to have a law suit against them... I think it is on purpose, anyone with half a brain will agree that Steve Jobs is most likely the single smartest living human and by far the best business man ever in human history. (note I do not own a single Apple product and have never paid for (or stolen for that matter) an Apple product, I do not even use iTunes.)

        For everything that anyone has ever complained about that an Apple product could not do, or did not have, there was a reason why, Steve just doesn't always tell us what that reason is.

      @dave95. well Apple is asking for announced but unreleased phones and packaging as well.
      This whole thing to me is a joke, no one would mistake an Apple product for a Samsung product. Just a bunch of who hah legal crap from both sides.

        and no one cares if the packaging is the exact same. It's like Lands end suing LL bean for sending shirts in the same style box. Wrap it in newspaper. As long as I get it undamaged. Apple should be fined for wasting the courts time and taxpayer money.

        Apple requested announced and shipping phones and tablets in relation to their trade dress case against Samsung.

        Samsung is requesting <b>unannounced</b> and <b>unreleased</b> phones and iPads that's totally unrelated to their patent case against Apple. Or Apple's case against them. Totally separated and an unprecedented request.

        This does all seem a little silly I agree, but I think most are in agreement that Samsung has blatantly cloned Apple's designs and ran with it. Even down to the packaging.

      @dave95. Samsung was simply responding with a slightly exagerated request that Apple made. Show us the next version stuff (soon to be released) to see if it is copying ours. Okay, but show us your next version to make sure we won't accidently copy it.

        @grayknight <br><br>Again. This has no relevance to Apple's case against Samsung or Samsung's follow-up counter case against Apple. Samsung already countersued Apple for patent violations in response to Apple suing them first. So where does this new request fall? <br><br>What they're requesting is baseless and unprecedented, and no judge is going to grant it to them. If they do then that just opens the door for any company to request to see a competitor's future unreleased products. Just because! It's down-right silly. <br><br>Apple's requested to see Samsung devices was already shipping or shown. And most importantly, it is related to their <b>Trade dress</b> case they're building against Samsung. That's why their request was granted, Apple is building a trade dress case.       The Samung Galaxy S & SII look NOTHING like an iPhone. As is becoming the norm for Samsung products, they look superb. The S2 in particular is very edgy looking. The iPhone is by contrast, a very boring looking device.

      Have you SEEN the new TV's Samsung are releasing this year? Guess Apple will want credit for that too.....

      No one is copying apple as apple copies others ideas then puts an ugly housing on them. No one wants to have a product thats looks as ugly as apple products that would be stupid

      @Misha35 There was me thinking Samsung had a major part in making the present devices. And maybe with all the hoohah they're keen to see that the next co isn't using their processes. Just a rash thought. Go SAMSUNG... get into them !
