Priceline founder files patent suits aimed at Apple, Google, Microsoft, more

A group of lawsuits filed on Monday by Priceline founder Walker Digital take aim at Apple, Google, Microsoft, Amazon and more than 100 other companies for infringing on key parts of its patent portfolio.

The 15 lawsuits, filed in US District Court of Delaware, say these companies are infringing Walker Digital-owned patents covering things like e-commerce, private social-networking communications, online auctions and a driving-directions tool with visual cues.

"A number of great companies can trace their genesis to technology that was first developed at Walker Digital in the mid-to-late 1990s," Walker Digital's chairman Jay Walker said in a statement. "We are proud of our inventions and the number of innovative businesses and activities founded on these inventions. These businesses have not only changed the way people around the world live, work, travel and interact socially and commercially, but also have given rise to numerous American jobs."

  • What's the patent?

    Let me guess - "a web page that is designed to sell a product, either over the phone or though the site itself, via the internet, with the owner(s) shipping the product through the US mail, or other delivery systems"

    There that about covers EVERYTHING!!

    • Another example of our pathetically broken patent system.

      This is another nauseating example of how the United States produces little of value, but rather pushes paper "wealth" around for worthless "goods" in a massive house of cards that's coming down.

      Software and "business methods": two things that are not supposed to be patentable, and yet patents on them are used to extort money from victims or bully them out of existence. If the president really wanted to foster innovation and entrepreneurship, fixing the USPTO would be at the top of his list of priorities. Yet he has done nothing.

        @dgurney The assembly line, the Personal Computer (Which youre using right now to say we produce nothing of value), the first 'feasible' lightbulb, movies, DC electricity, AC electricity, not to mention all the medical, construction, and various other innovations. Yes nothing of value indeed.

        Just about everything you use from awakening until sleep has been invented and produced in this country; and, until the greed of both labor and management overwhelmed them, we were still producing.

        One other thing it produced is guys like me who have gone to war repeatedly for the likes of you and then wonder why ..

        Yeah, but the we barely managed that in spite of the US government! They pittance ARPAnet received was nothing compared to the federal regulatory effort behind keeping AT&T as a monopoly, and AT&T tried to abort the internet at birth. They argued that packet based switching was fundamentally unfeasible. TCP/IP, ethernet, ****! even the small form factor pluggables are all opensource! Almost nothing "closed" exists today.

        @nickdangerthirdi The taxpayer doesn't pickup the court costs on these types of suites. Both the defendants and plaintiffs pay for their own court costs up front and then if the plaintiffs win, the defendants usually have to cover the court costs in with the settlement. If the Plaintiffs lose, then the defendants have the option to counter sue and usually they sue for damages, plus their legal expenses for both trials.

        Now, if you said the consumer loses, then I would agree with you, as who ever loses, will end up passing those costs on to us.

        Actually the assembly line is not tangible, it's a process used in manufacturing that revolutionized the world, thus it is relevant. The PC, and all the software developed for it, fall under the umbrella.

        The idea I responded to was; "This is another nauseating example of how the United States produces little of value, but rather pushes paper "wealth" around for worthless "goods" in a massive house of cards that's coming down."

        The scope was not limited to processes or software but production, and we still produce. Thus all my points are valid.

      @Will Farrell Wow, substitute 'catalog' for 'web page' and 'via mail order or other communications' for 'through the site itself, via the internet' and you have described any catalog ever published. Transformation through technology does not equal patentable idea. I hope the patent says more that what you quoted or these guys should get a big fat bill for wasting peoples time and money.

      Of course if the 'owner' does not ship the product but has an employee do it or only arranges to drop-ship then even the direct wording breaks down.

    I have a feeling Priceline will win these suits because if they don't they will hire William Shatner to come after you. Or will Priceline use the priceline negotiator to determine a price for settling?

        Overly broad patents issued through an ill-informed patent process have a good chance of being invalidated as a result of insufficient "prior arts" being disclosed at the original filing. Happens all the time. But if you hold the patent (even if it's essentially bogus) and DON'T defend it, it's invalidated by the legal doctrine of 'laches'. I think that software patents are not necessarily a bad idea, but it can be a real catch-22 if you have to defend a questionable one!

      LOL. They should use that negotiator and finally make a buck out of it like the Android Phone offers that existed on Wirefly and LetsTalk a while back like signup two year contract you get free phone and make $50 as mail in rebate or something. :D
