You apparently missed the live demos during E3 coverage. Most gestures have to be very deliberate, such as making a screen selection by holding your hand-cursor on a spot on the screen for a couple of seconds, and others (like a swipe motion) are only active on screens with stacked tiles. No one who has reviewed the KINECT from first-hand experience has reported the behavior you fear. So, go ahead and pick your nose with wild abandon -- the KINECT won't send you to Netflix or a Halo match when you do.
