I haven't looked at the details of the settlement, but $8.5 million is so low that it suggests that the plaintiff had no case beyond just causing Google some bad P.R. by making a noise.
I'm not suggesting that Google didn't screw things up with their introduction of Buzz, I'm just saying that (it appears) that this lawsuit had nothing.
Just wait for word of the settlements regarding the Wi-Fi sniffing thing. As well as any legit lawsuits and legal actions there will be countless baseless class-action suits meant to extort a settlement from Google.
