Arstechnica has this story on a man being convicted for child pornography whose "Open Access Point defense" was shot down. I'm not sure we can really blame the Open Access Point defense here, because the police actually found CDs with child porn inside the convicted man's room.

The FBI says it found CDs with child porn in Perez's room, the only one it searched

Still, this shows why you want to make sure that you lock down your wireless LAN with real security in your home, even if you think you have nothing of value for anyone to steal.  Even if you have nothing to hide, having the police raid your home searching for illegal child porn isn't the most pleasant experience in the world.
