Apple adds DMCA charge to Psystar suit

It appears that Apple is trying to put the final nail in Psystar's coffin, asking the court to accept an amended complaint against the Mac clone maker to add a charge of violation of the Digital Millenium Copyright Act to a long list of allegations, including trademark infringement, breach of contract and copyright infringement.

On Nov. 18, a federal judge kicked Psystar's countersuit back,  giving the company until Dec. 8 to amend its complaint with a more solid argument to support its allegation that Apple is engaging in anticompetitive business practices.

Adrian Kingsley-Hughes, in a Hardware 2.0 blog entry, posts excerpts of Apple's amended complaint, highlighting Psystar's inclusion of an OS X "restore disk"with the Psystar computer and instructions on how to install Apple's operating system on non-Apple computers. Apple sued Psystar in July. (PDF of original complaint) The following month, Psystar filed its countersuit, a move that some legal experts said was Psystar’s best chance at winning the legal battle and staying in business.
