McKinnon judicial review application on Tuesday

Nasa hacker Gary McKinnon's application for a second judicial review will happen on Tuesday.

The review, at the Royal Courts of Justice, is to apply for a decision as to whether McKinnon could be prosecuted in the UK.

Sting's wife Trudie Styler is expected to show support for McKinnon and his family by attending the hearing.

"I am appalled that Gary's family have had to go through so many legal hoops over the past seven years to try to get someone in authority in the UK to recognise and resolve the plight in which Gary now finds himself," Styler said in a statement on Monday. "This fiasco is due to the imbalance in the UK/US extradition laws and buck-passing within government. The Home Secretary's behind-the-scenes advisors say it's a matter for the director of public prosecutions or the courts, whilst the director of public prosecutions' advisors say it's a matter for the US. Meanwhile the torment continues for Gary and his family."

"Someone at the highest levels of government must now take responsibility and say enough is enough," Styler continued. "Plain common-sense dictates that he should be tried in the UK. I look forward to somebody with the necessary clout stepping up to the plate and making that happen."

ZDNet UK understands that Gary McKinnon will probably not be at the hearing on Tuesday.
