U.S. District Court Judge Thomas Penfield Jackson on Thursday turned down a request by Microsoft to exclude new evidence unearthed by the Department of Justice from the antitrust case against the company. Jackson said he will rule on the relevance of the new evidence when a trial begins in the case Oct. 15.
